The court in Abu Dhabi issued an order that a young man must pay a sum of 5,950 dirhams to another individual because he caused damage to his vehicle. This is in addition to the traffic offenses that were committed against him.
In its ruling, the court ruled that the young man was obligated to pay these amounts of money, which is the value of repairing the damages and traffic violations incurred after he borrowed the plaintiff’s car and destroyed it, which is the value of repairing the car.
5000 dirhams for car repair
The plaintiff's case sought that the defendant pay 5,000 dirhams, the cost of fixing the vehicle, traffic penalties, fees, and expenditures.
The plaintiff said he gave the defendant his car to use because of their friendship, but the defendant damaged it by causing a gear transmission problem and many traffic violations and accidents.
When he asked the defendant to pay the repair amount and traffic violations, he delayed, but the plaintiff provided a repair invoice, a statement of traffic violations, and WhatsApp messages, and the defendant agreed to pay the violations.
Refusing to bear the cost of repairing the car
The plaintiff inflated the cost of vehicle repair, thus the defendant refused to pay. The court stated that, under the Civil Transactions Law, “you are responsible for what you take until you return it,” and that “it is not permissible for anyone to take another person’s money without a legitimate reason, and if he takes it, he must return it.”
Noting that the papers and WhatsApp emails between the parties confirm that the plaintiff delivered the vehicle to the defendant and repeatedly asked him to repair the gearbox and pay the fines, but the defendant was delaying his payment.
Car repair bill
In the case preparation office, the court confirmed that the traffic violations lists, the defendant's acknowledgment of paying the violations, and the car repair invoice all show a repair value of 5,000 dirhams. Additionally, the court confirmed that the defendant acknowledged paying the violations. After the defendant has paid the claim amount, the plaintiff is given the money.
It was ruled by the court that the defendant pay the plaintiff 5,000 dirhams, 950 dirhams for traffic infractions, as well as any fines and fees that were appropriate.
