An individual of Arab nationality accumulated traffic violations totaling 35,000 dirhams while driving a rented luxury Ferrari car within just four days.

Despite this, he refused to pay a portion of these fines to the vehicle rental company that owned the car. Consequently, the rental company initiated legal action against the individual after attempts to resolve the dispute amicably failed.
Lawsuit details
The luxury car rental company filed a lawsuit demanding that their customer be held liable for an amount totaling 23,872 dirhams, along with a 5% legal interest from the date of the claim until full payment. This amount was based on the claim that the defendant rented a Ferrari vehicle from the company for four days at a daily rate of 2,939 dirhams and subsequently committed multiple traffic violations.
According to the lawsuit, the rental company expected the defendant to pay 8,817 dirhams as the rental fee upon returning the vehicle. However, upon receiving the car back, they discovered that the defendant had accumulated 13 traffic violations amounting to 35,660 dirhams. Additionally, the defendant had been involved in an accident with another vehicle and fled the scene.
Despite the company's attempts to communicate with the defendant and request payment for both the rental fee and the fines, the defendant only initially paid 4,000 dirhams and still owed 8,817 dirhams as per the rental contract. The defendant later paid 11,487 dirhams for four of the violations and an additional 6,060 dirhams. However, they adamantly refused to pay the remaining amount of 23,872 dirhams owed.
Efforts to settle the matter outside of court were unsuccessful, leading the rental company to file a lawsuit. In support of their case, the company presented a copy of the lease contract and a report detailing the traffic violations.
The defendant failed to appear before the court, prompting the court to appoint an accounting expert to examine the documents. The expert's report concluded that the defendant owed the company a sum of 20,000 dirhams.
In its ruling, the court justified its decision to seek the expert's opinion and expressed satisfaction with the report, accepting it in its entirety based on the reasoning provided. Consequently, the court ordered the tenant to pay the sum of 20,028 dirhams to the plaintiff company, along with a 5% legal interest, from the date of the claim until full payment.
