The Ministry of Justice has heralded a significant milestone in the realm of real estate laws with the introduction of Law No. (5) of 2024 on real estate registration, spearheaded by Sheikh Tamim bin Hamad Al-Thani.
This enactment marks a groundbreaking transition towards electronic registration services, a pioneering move within Qatar's legal framework. This stride represents a departure from the longstanding Law No. (14) of 1964, showcasing the nation's commitment to advancing its real estate sector in alignment with its broader developmental objectives.
At its core, the new legislation comprises 55 meticulously crafted articles, meticulously tailored to modernize and streamline real estate registration procedures. Among the key focal points are enhancing accessibility to registration services for citizens through state-of-the-art technological platforms and integrating best practices from the sector. Notably, this overhaul encompasses an array of facets, including registration services, record-keeping, documentation, and the adjudication of ownership rights.
A fundamental aspect of the law is its embrace of electronic modalities for conducting registration procedures, underpinned by stringent regulatory oversight to ensure parity with traditional paper-based processes. Furthermore, the legislation mandates the registration of all transactions pertaining to ownership rights and prescribes stringent penalties for any illicit activities in this domain.
The law underscores the primacy of citizens' rights by mandating notification through their national addresses for all relevant transactions. It solidifies the role of the real estate registration administration as the authoritative custodian of ownership records, imbuing the registry with legal sanctity.
Saeed Abdullah Al Suwaidi, Assistant Undersecretary for Real Estate Registration and Documentation Affairs, lauded the enactment as a culmination of extensive consultations with stakeholders and legislative authorities. He expressed optimism that the law would serve as a cornerstone for delivering judicious services tailored to the needs of Qatari citizens.
Moreover, Law No. (5) of 2024 on real estate registration ushers in a new era of efficiency, transparency, and legal robustness in Qatar's real estate sector. By embracing electronic registration mechanisms and fortifying safeguards for citizens' rights, this legislative milestone sets a precedent for progressive legal reforms aimed at fostering a thriving real estate landscape in Qatar.
