An Egyptian man is seeking Dh1 million in compensation from a female driver who caused a five-car pile-up, resulting in his permanent disability.
Reckless Driving Incident
The man, who holds a managerial position, filed a civil compensation claim in the Sharjah Civil Court to address the medical, physical, financial, and mental damages he suffered due to the accident.
Last week, the Sharjah Traffic Court found the Emirati woman guilty of reckless and inattentive driving, leading to the accident. After pleading guilty, the court fined her Dh1,000 and referred the civil lawsuit to the appropriate court for further proceedings.
Accident Details, Legal, and Medical Proceedings
Sheikh Mohammed Bin Zayed Road was the location of the collision. As per statements provided by traffic authorities and eyewitnesses, the woman unlawfully and irresponsibly veered leftward from the extreme right lane, causing a collision with the vehicle positioned to her left. The initial collision incited a series of events that ultimately involved four additional vehicles. The collision caused grievous injuries to the Egyptian male, who was an occupant of the third vehicle.
The man’s lawyer, Hani Hammouda Hagag, detailed in the lawsuit that his client suffered a significant shoulder injury, leaving him with a disabled shoulder. His movement is now severely restricted, as he cannot lift any weight or properly move his left shoulder.
In the court submissions, the lawyer presented medical reports that confirmed the extent of his client's injuries. Shortly after the accident, the Egyptian man underwent surgery on his left shoulder in March. The medical diagnosis was a "closed dislocation of the left acromioclavicular joint." The medical report further noted that the injury caused the man significant pain and restricted movement in his left shoulder.
During the surgical procedure, doctors fixed plates and screws in his shoulder to stabilize the joint. Despite the medical intervention, the man continues to experience limited mobility and chronic pain, which has impeded his ability to perform daily activities and fulfill his professional responsibilities.
The civil compensation claim seeks to cover the costs of medical treatment, the financial losses due to his inability to work, and compensation for the pain and suffering he has endured. The lawsuit aims to hold the reckless driver accountable for the severe impact her actions have had on the victim's life.
The outcome of the civil case will determine the extent of the compensation awarded to the Egyptian man, taking into account the lasting effects of his injuries and the overall impact on his quality of life. The case highlights the serious consequences of reckless driving and the legal avenues available for victims seeking justice and reparation for their losses.
