The UAE issues a decision regarding work permits

ahmed atef - | Arab News

A "work permit to recruit a worker from outside the country," a "transfer work permit" that permits establishments to hire a worker inside the country after the end of his previous employment relationship, for a period of two years, and a "work permit for those" enterprises are allowed to hire workers from within the state who are not allowed to reside with their employers. The Ministry of Human Resources and Emiratization has linked the granting of new work permits to private sector establishments and companies registered with it to the need to provide the establishment with adequate worker housing.

The ministry also drew up a list of the various types of work permits on its official social media pages. These include a "temporary work permit," which permits businesses to hire an employee from within the nation for a job that necessitates working in establishments other than the one in which they are employed, and a "mission work permit," which permits businesses to hire employees part-time. This permit permits businesses to hire employees from within or outside the state on a part-time employment contract, and the employee is able to work in one of the first and second level jobs at multiple employers simultaneously after receiving the permit from the ministry.

List of approved work permits

The list of approved work permits also includes a "juvenile work permit", which allows enterprises to hire a worker from within the country who has reached the age of 15 and has not exceeded 18 years, and a"training or student employment permit", which allows enterprises to train or employ a national or non-citizen student within the country who has reached the age of 15, and a"work permit establishments are allowed to hire citizens or children of the GCC countries, a" work permit for holders of Golden Residency", a" trainee citizen work permit"is granted to establishments registered in the ministry wishing to train a citizen according to his accredited scientific qualification, and a" freelance work permit"which is granted For individuals wishing to practice self-employment independently (on their own residence for foreign individuals), without the sponsorship of a specific body or employer in the country, and without requiring the existence of a valid employment contract, through which a person earns direct income by providing his services for a specific period of time, or to perform a task or provide a certain service, either to individuals or to enterprises, so that this natural person is not employed by these individuals or those enterprises, and finally "private teaching work permit".

Types of work permit violations

The government classified infractions into four categories, each of which prohibits businesses from receiving new work permits.First, if the enterprise violates any of the terms outlined in the Council of Ministers resolution on service fees and administrative fines in the ministry and its amendments, it will face an administrative suspension of its enterprise file until the outstanding fines are paid. Secondly, if the enterprise exploits its electronic powers to access the ministry's systems, or permits others to do so, it will face an administrative suspension of its enterprise file that will disrupt work procedures for a period of six months. The establishment is accused of committing human trafficking in the third violation, which entails suspending the establishment until it is proven innocent. The suspension lasts for two years after the establishment is found guilty. The last violation is the failure to provide housing for workers, which is in violation of the ministerial decision on occupational health and safety and workers' housing. In this case, the establishment's file is administratively suspended until housing is provided.

Standards and requirements for workers’ housing

In order to raise awareness about regular housing that complies with the standards and requirements of the ministry and its government partners responsible for overseeing workers' dormitories, as well as to improve the country's reputation as one of the best places to live, work, and invest in the world, the Ministry announced that it has launched an electronic system for workers' dormitories. This is the first national platform for registering workers' dormitories offered to companies in the nation.

The ministry states that the laws governing the standards and requirements for workers' housing include an integrated formula that takes into account health, comfort, and hygiene standards as well as other details that are crucial to ensuring the safety and comfort of workers. These details include the building's and the site's habitability, which includes having a sign with the company's name in both Arabic and English, water and electricity availability, air conditioning, proper lighting, and areas for eating, cooking, and washing. Additionally, the buildings housing workers must be constructed of non-flammable materials.

Along with providing adequate ventilation, sanitation, bathroom and hygiene supplies, and other details that attest to the accuracy and zeal of the ministry to achieve worker welfare, the requirements also include the presence of enough rest areas, beds, places for arranging tools and clothing for each worker, and other details that secure a decent living and housing environment, consistent with the state's position as one of the best places to live in the world and its leadership in the global community.
